The future of the Los Angeles Dodgers continues to remain up in the air, as owner Frank McCourt continues to battle Major League Baseball in the courts.

Just this week MLB went on the opposition against McCourt, who filed for bankruptcy, alleging that the owner has driven the organization into the ground, and should no longer be allowed to control the team.

MLB issues a reports stating that McCourt siphoned off well over $100 million of club revenues and obviously unable to properly distinguish between his personal interests and those of the club.

As a result, the liquidity aspect of the team appears to be in serious jeopardy.

While the two sides continue to go back and forth, one name that has come up as a possible future owner of the team is Dallas Mavericks owner Mark Cuban.

Cuban and the Mavericks have been in the headlines lately for their first NBA championship just weeks ago when they defeated the Miami Heat. Short thereafter, Cuban expressed some interest in buying the Dodgers.

If the deals right and theyre fixable, then, yeah, Im very interested, Cuban said.

They [MLB] might just take it back and decide not to sell it for a while, right, because theyre not stupid, either, he added. They might say well take it back, well fix it up some, and clean up some of the mess and then well sell it.

Teacher Defends Affair With 18-Year-Old Senior

AUSTIN (CN) – A teacher sued the State Board for Educator Certification for revoking his credentials because he had two consensual, off-campus sexual encounters with an 18-year-old senior, who never had been his student, nor attended his school, nor even the district where he taught, and acknowledged that she instigated the relations.
The Texas Education Agency accused Robert Lange of violating the Texas Educator Code of Ethics by having an inappropriate relationship with a student in a hearing before the State Office of Administrative Hearings, according to Langes complaint in Travis County Court.
Lange says the agency overstepped its authority by revoking his license, and lays out a series of facts to back up his case that his contact with the 18-year-old, referred to as CS, was not inappropriate.
Lange was not CS teacher (nor had he ever been) … The sexual encounters did not occur on school property. They occurred in a martial arts studio on private property … The sexual encounters did not occur during school time. They occurred in late December and early January when school was not in session.
In addition, CS attended school in Mesquite Independent School District in Dallas County, while Lange taught in the Plano Independent School District in Collin County.
Lange continues: The sexual encounters did not occur directly or indirectly within the context of any school activity. CS received no extra credit for her participation in the martial arts program. At the time of the sexual encounters in question, CS was an adult, 18 years of age, acting on her own volition, admittedly instigating the two sexual encounters.
After their second encounter, in January 2007, Lange and CS had no further contact, Lange says.
An administrative law judge issued a decision in August 2010 and found that Lange had engaged in oral sex acts with a student, CS, while CS was a high school senior and recommends TEA revoke his certificate, according to the complaint.
Lange filed exceptions to the decision and though the State Board for Educator Certifications board struggled with the issue it sided with the judge, and revoked Langes credentials in April this year.
Lange, who had been certified to teach in Texas public schools since 1979, filed a motion for rehearing, which the board denied.
He claims the agency breached his due process rights under the Texas Constitution by adopting the judges decision, and that his revocation is not reasonably supported by substantial evidence considering the reliable and probative evidence in the record as a whole.
Lange asks the court to reverse and remand.

Alabama gambling trial highlights practice of lobbyists paying referral fees …

MONTGOMERY, Ala. Alabamas gambling corruption trial has exposed a little-known source of income for some legislators: thousands of dollars in referral fees from lobbyists who are trying to influence their votes.

Testimony in the case shows that Republican state Rep. Barry Mask of Wetumpka and former Democratic Rep. Terry Spicer of Elba were paid for referrals for years.

Jim Sumner, executive director of the State Ethics Commission, said hes not aware of any other legislators who got referral fees. Im very wary of these because of the conflict of interest thats created, Sumner said in an interview.

Country Crossing casino lobbyist Jarrod Massey testified in a pretrial hearing that he paid Spicer $1,000 to $2,000 in cash monthly for six or seven years while he was serving in the Alabama House for referring clients to him. Massey said the referrals from Spicer included Country Crossing developer Ronnie Gilley, who became his No. 1 client.

Both Massey and Gilley have pleaded guilty to offering millions in bribes to legislators to support pro-gambling legislation.

Spicer, who was defeated in November, serves as school superintendent in Elba.

He did not return phone calls seeking comment about the payments. A review of the financial disclosure forms he filed with the Ethics Commission each year do not show any payments by Massey.

Masks annual ethics forms do show he got payments from former Lt. Gov. Steve Windom, whose lobbying clients include Computer Associates. Legislators check broad ranges of dollars on the forms instead of listing specific amounts. In most years, Mask listed his referral fees from Windom as being between $10,000 and $50,000. Windom said in an interview the amounts have varied, but they have been on the low end of the $10,000 to $50,000 annually.

Mask is a former lobbyist for several groups, including the Business Council of Alabama. He is one of three legislators who helped the FBI with its investigation of Statehouse corruption.

He testified that he recommended Windom to Computer Associates in 2004 before being elected to the Legislature in 2006. His agreement with Windom called for him to get referral fees as long as Windom kept the computer company as a client.

Sumner said Alabamas ethics law does not address referral fees specifically, but it does prohibit a public official from using his position for personal gain. He said Masks situation is different because the referral fee started before he was elected to the Legislature.

The Ethics Commission has never issued an advisory opinion on the fees because nobody has ever asked, Sumner said.

But he made his view clear: I dont think a member of the Legislature should be paid for recommending a client to a lobbyist.

Sumner said referral fees are reminiscent of what went on in the Legislature before the enactment of Alabamas first ethics law in 1973. At that time, many seats in the Legislature were held by lawyers and it was common for them to get retainers from utilities, insurance companies and other major corporations.

The ethics chief said the new law caused the retainers to start disappearing and the number of lawyers in the Legislature to decline.

I dont think we ever want to go back to that, he said.

Rank (Mecca) Gambling Group Accepts Share Take-over Offer

Rank, otherwise known to us online bingo and slots players, as Mecca Games or Mecca Bingo, has been fobbing off a take-over offer by Guoco Group for quite a few weeks now. At first shareholders were advised not to accept any offers for their shares, but it looks as though this is actually going to happen and independent directors of Rank Group plc are going to accept the 150p per share bid in respect of their own shareholdings. They also seem to have had an about-face and are advising other shareholders to do the same – in other words, accept the offer. However, they do still maintain that this low offer considerably undervalues the company.

Despite repeated calls to reject the offer in this take-over bid, at the first closing deadline – 7th June; 15.6% of shareholders had accepted. Across the board this offer expires on the 1st July and will not be extended by Guoco. In the wake of Rank shares being de-listed on the London Stock Exchange shareholders have been advised to accept as should the company shareholding fall below a 25% free float; shareholders could end up being materially restricted.

It is the intent of Guoco to maintain the listing of the company on the London Stock Exchange; however, they have also reserved their right to consider all options. Rank is on the main market for listed securities and in the event of a cancellation of the listing shareholders would own unlisted shares in a company controlled by Guoco Group. What impact this will have on Mecca Games, is hard to foresee at this point in time, but in the meantime share prices are falling quite dramatically. Currently Rank believes that Guoco does not have sufficient acceptances from shareholders to justify cancellation of the company shares.

Quinn not rushing gambling decision

Whether Illinois will see five new casinos and the Illinois State Fairgrounds will have slot machines remains up in the air as lawmakers wait to hear Gov. Pat Quinns specific objections to a massive gambling expansion bill.

Quinn said Thursday in Chicago it would be weeks before he makes any decisions regarding the legislation. He plans to continue meeting with supporters and opponents.

Its a very complicated piece of legislation, and it deserves scrutiny from top to bottom, and thats what I intend to give it, Quinn said. I think thats a healthy thing for this state, to make sure the governor looks at every sentence to make sure nothing goes wrong. I want to hear from them (supporters and opponents) firsthand and to ask questions and have them give their opinions and ideas.

In the meantime, Senate President John Cullerton, D-Chicago, said he plans to continue holding the bill in the Senate via a parliamentary maneuver until the governor tells lawmakers what he objects to and they consider a follow-up bill to deal with Quinns concerns.

Theres no sense in giving it to him to veto it, Cullerton said.

Quinn said hes puzzled by that approach.

If you believe in a bill, and apparently there are members of the House and Senate who believe in this bill, then not sending it to the governor, I feel, is kind of curious, odd, Quinn said.

Asked what could be changed in the bill to assuage Quinns concerns that it is top-heavy with new gambling, Cullerton said, Theres no sense in speculating. Its up to the governor.

Lawmakers, including Cullerton and the legislations sponsor, state Sen. Terry Link, D-Waukegan, recently met with Quinn about the gambling bill. Link described the session as an educational one for the governor.

Link compared Quinns process in examining the bill to the governors soul searching over a bill he signed earlier this year abolishing the death penalty. Quinn waited for months, meeting with supporters and opponents and reading research on the topic, before he signed the bill.

Quinn asked lawmakers about the relationship between horse racing and the agricultural industry, Link said. Agricultural interests are urging that he sign the bill because the industry has tens of thousands of jobs related to horse racing. Supporters have said the purses for racing would be bolstered by the addition of slot machines at racetracks.

He wanted to know … how many agricultural people were really involved. Some reports show its 30,000, some show its 40,000. Whats the true amount? Link said. How much money really was involved with agriculture? … If we took horse racing out of the state of Illinois, if it went under, how many people would be affected, how much money would be affected? Those are the types of things he wanted answers to.

Link said he did not take those questions as an indication that Quinn plans to file an amendatory veto that removes slot machines from the bill. Quinn also wanted to know if expanded gambling would cannibalize the state lottery, Link said.

Were going to try to run some numbers to show that type of thing, that this is not going to affect that industry, Link said.

Lobby dollars and a dream

ALBANY — Genting, the Malaysian resorts and gambling company, envisions itself becoming rich in North America by changing the New York state constitution.

The international gaming powerhouse, little-known in the United States, is planning to operate a Las Vegas-style casino at Aqueduct Racetrack, which is banned by the state constitution.

But Genting is spending about $1 million a year with lobbyists in Albany to make its dream of the Queens project a reality by amending the constitution.

The Asian company builds world-class destination resorts. Just two of its casinos, one in Singapore and the other in Malaysia, are expected to eclipse all of the Las Vegas gambling palaces combined in revenues next year.

Genting looks at the 5,000-machine video lottery terminal emporium it is building in South Ozone Park near JFK International Airport as a US beachhead for much bigger things, according to numerous interviews with people in the gambling industry.

The Aqueduct project is named Resorts World Casino New York, even though it is a racino, only able to operate video lottery terminals (VLTs), which Genting executive Colin Fook Yew Au admitted last week arent as good as actual slot machines. Theyre not much better than VLTs, but still better, Au told the state Franchise Oversight Board in a spirited appeal in which he argued against off-reservation tribal casino expansion and revealed a desire to build a convention center and hotel at Aqueduct.

Au did not discuss the big-picture plan of changing the state constitution, but a spokesman said Gentings agenda includes looking at a range of ways to further develop the Aqueduct site — a new convention center is one possible concept — to create more jobs and generate additional economic revenue for New York state.

We also firmly believe that racetrack casinos should be allowed to become fully commercial casinos, the spokesman, Stefan Friedman, said. Neither of these goals is easy to achieve, and we want to give ourselves the best chance of success.

To that end, Genting, working with the newly formed New York Gaming Association, a coalition of VLT operators, is beginning to flex its considerable muscle in Albany to win a constitutional amendment that would allow racinos to convert to full-blown casinos, according to numerous interviews in recent weeks. Although the public disclosures on its lobbying forms dont declare specifically what theyre up to, Genting has slowly built up a stable of influential lobbyists, paying one an extraordinary $35,000 a month in a town in which $10,000 is closer to the norm.

Four firms led by former Senate GOP lawyer John Cordo, former Assembly Democrat communications director Patricia Lynch, veteran Queens lobbyist Brian Meara and former Republican Sen. Nicholas Spano are splitting more than $1 million in fees. They are walking the halls of the Capitol representing Gentings interests, even though the Asian company has no legislation pending.

Its all about building toward a positive vote early next year on a legislative resolution to change the constitution. A second passage of the resolution in the Legislature would have to follow in 2013 to put the proposition before voters in the November 2013 election, said James Featherstonhaugh, president of the New York Gaming Association, which represents all nine racino operators. Featherstonhaugh, a veteran lobbyist with a stake in the Saratoga harness track and VLT operation, said Genting is building a lobbying team to help push the NYGA agenda.

Theyre staffing up to get NYGAs constitutional amendment, he said. Genting actually has two votes on the NYGA board because it also has the controlling interest in Monticello Raceway, which, like the other racinos, has its own lobbying team. Featherstonhaugh said his groups agenda and campaign will become fine-tuned soon after this session when NYGA will install an executive director, Michael Wilton, who has been a lobbyist with Patricia Lynch and Associates. Featherstonhaugh said Genting is very aggressive.

Such characteristics were on display before the Franchise Oversight Board, where Au said the state cannot allow tribes to set up off-reservation casinos in the Catskills or in Nassau County if they want the Aqueduct racino to stay open.

The threat from the Indians are many, Au said. They can stay at their reservations, they have their rights. You should not let them encroach in the main metropolitan areas. Later he told a reporter that the Shinnecock, on Long Island, should not be so greedy to want to build a casino outside of their reservation while they could probably do $200 million in business with an casino on their current territory.

Roger Gros, publisher of Global Gaming Business, said Gentings plan has always been to make New York City a world-class casino destination. This was really just a stepping stone; theyve been interested in getting in the United States for some time, he said. I think this has been their plan all along, that once they got in there they would lobby for table games and a hotel.

Recently, Genting purchased the Miami Herald building and grounds — 14 acres for $230 million — with the intention of building another resort as lobbyists pursue a change of Florida law to allow non-Indian casinos. Genting employs three lobbying firms in Florida to promote their plan, spending what would likely be as much as $300,000 on an annual basis based on Times Union calculations of the value of contracts. Their project in Miami will give them a leg up on other casinos companies should the laws change, said Gros. Lobbyists shouldnt have that power, complained Assemblywoman Aileen Gunther, D-Sullivan County, who sees Genting as working against her countys goals of obtaining a tribal casino and its own convention center. Its not fair. Money talks.

Genting, with $5 billion in cash reserves, paid New York $380 million for the rights to build and operate at Aqueduct, blowing away competitors bidding on the same 30-year contract. The sum was seen as not commensurate with the potential return because VLT operators have to give so much of their betting revenues to the Division of the Lottery for public education funding.

A constitutional amendment in New York is a risky bet, but perhaps the states mood is shifting, said the Rev. Duane R. Motley, founder and senior lobbyist for New Yorkers for Constitutional Freedoms, which opposes gambling. He said the state Senate has become more moderate since the last time it dealt with the notion of a constitutional change allowing casinos. I think they might put it out there to the people, but the people of New York have a history of voting down constitutional amendments; very few pass, he said.

Funded with an ample supply of cash from Genting, the coalition seeking the change will likely develop a slick marketing campaign with TV ads talking about how gambling dollars and the jobs they can bring are being lost to neighboring states. It will come at a time when Gov. Andrew Cuomo will be looking for ways to improve state revenues, an official with one of the participating lobbing firms said. Cordo, whose firm is hired for consulting and public relations services, was part of a team that promoted the $2.9 billion transportation bond act on the ballot six years ago which passed comfortably. He once worked for Featherstonhaugh, who has longstanding ties to the Cuomo family. An aide to Gov. Andrew Cuomo was unsure of the governors stand on a constitutional change.
